We've kept this document complete in the language privacy law requires, and we've tried to keep it as readable as possible. This Privacy Policy describes how Delphi Rive ("Delphi Rive," "us," "we," or "our") collects, uses, shares, and protects personal information when you visit www.delphirive.com (the "Site"), purchase our pieces, sign up for our communications, or otherwise interact with us.

By using the Site or providing your information to us, you confirm that you have read this Privacy Policy and understand how we handle your information. If you are a resident of California, Nevada, or the European Union, the United Kingdom, or Switzerland, additional rights apply to you and are set out in the appendices below.

This Privacy Policy applies alongside our Terms & Conditions, which govern your broader use of the Site and your purchase of our pieces.

Information We Collect

We collect two types of information about you: Personal Information (information that identifies you as an individual) and Other Information (information that does not, on its own, identify you).

Personal Information You Provide

When you interact with us, we may collect:

Postal address (billing and shipping)

Telephone number
Payment information (credit or debit card number, expiration date, security code)
Account credentials (username and password) if you create a Delphi Rive account
Date of birth, where required for age verification
Order history and purchase preferences

When you visit the Site, we and our service providers automatically collect:

Referring website and the search terms used to find us
Information collected through cookies, pixels, and similar technologies (see Cookies & Tracking below)

Information from Third Parties

We may receive information about you from:

Payment processors and financial institutions (to verify and complete transactions)
Marketing and advertising platforms (Meta, TikTok, Google) to help us understand campaign performance
Analytics providers (Google Analytics, Wix Analytics, Klaviyo)
Social media platforms, when you engage with us through Instagram, Pinterest, TikTok, or Facebook

How We Collect Information

Directly from you — when you place an order, create an account, sign up for our newsletter, contact Customer Care, or otherwise interact with us

How We Share Your Information

These providers process information on our behalf under contractual obligations limiting their use of the information to the services they provide to us.

Advertising & Marketing Partners

We work with advertising and marketing partners — including Meta (Facebook and Instagram), TikTok, Google, and Pinterest — to deliver advertisements about Delphi Rive and to measure their effectiveness. These partners may receive information about your activity on the Site (collected through cookies, pixels, and similar technologies) and may combine that information with data they hold about you from other sources to deliver personalized advertising.

Under California law, this practice may be considered a "sale" or "sharing" of personal information. California residents may opt out — see Appendix A.

We may share information for any other purpose disclosed to you with your consent.

Cookies & Tracking Technologies

We and our service providers use cookies, pixels, web beacons, and similar technologies to operate the Site, understand how visitors use it, and deliver relevant marketing.

Email & SMS Marketing

With your consent, we send marketing communications about our pieces, collections, offers, and events through email (and, where you have separately opted in, SMS messages).

Email

You may unsubscribe at any time by clicking the "unsubscribe" link at the bottom of any marketing email, or by writing to privacy@delphirive.com. We will continue to send you transactional emails relating to your orders, account, and customer service inquiries.

SMS

If you opt in to receive SMS messages from us, you consent to receive recurring marketing text messages at the mobile number you provide. Message and data rates may apply. Message frequency varies. You may opt out at any time by replying STOP to any message we send. For help, reply HELP or write to privacy@delphirive.com.

Your consent to receive SMS messages is not a condition of any purchase. SMS marketing is provided through our partner Klaviyo; please see their privacy policy for additional information about their data practices.

Your Choices

You have several choices regarding your information:

Marketing communications — opt out at any time by clicking "unsubscribe" in any email, replying STOP to any SMS, or writing to privacy@delphirive.com
Account information — review and update the information in your Delphi Rive account at any time by logging in
Cookies and tracking — manage cookies through your browser settings; opt out of advertising cookies through the industry programs listed above
Cross-context behavioral advertising (California) — opt out via our Do Not Sell or Share My Personal Information page
Deletion or correction — request that we delete or correct your personal information by writing to privacy@delphirive.com; additional rights apply to residents of California, the EU, the UK, and Switzerland (see appendices)

If you have an account with us, we may still send you transactional and account-related communications (order confirmations, shipping notifications, customer service responses) regardless of your marketing preferences.

How We Protect Your Information

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information against loss, misuse, unauthorized access, disclosure, alteration, or destruction. The Site uses SSL/TLS encryption for transactional pages, and access to personal information is restricted to authorized personnel and service providers who need it to perform their duties.

No system is entirely secure. While we work to protect your information, we cannot guarantee absolute security. If you have reason to believe your interaction with us is no longer secure, please write to us at privacy@delphirive.com.

How Long We Keep Your Information

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including:

To complete your transactions and provide services you have requested
To maintain your account, where you have one
To comply with our legal, tax, and accounting obligations
To resolve disputes and enforce our agreements
For up to ten (10) years where required by tax or other applicable law

When personal information is no longer needed, we will delete or anonymize it. We may retain aggregated or de-identified information indefinitely.

Third-Party Sites & Content

The Site may contain links to other websites, social media platforms, or third-party services. This Privacy Policy does not apply to those sites or services. We are not responsible for their privacy practices, and we encourage you to review their privacy policies before providing them with your information.

International Data Transfers

Delphi Rive is based in the United States. If you access the Site or place an order from outside the United States, your personal information will be transferred to, stored, and processed in the United States, and may also be transferred to other countries where our service providers operate.

The data protection laws of the United States may differ from those of your country of residence. By using the Site or providing information to us, you consent to this transfer, except where additional safeguards apply by law (see Appendix C for residents of the EU, UK, and Switzerland).

Children's Privacy

The Site is intended for users who are at least eighteen (18) years of age. We do not knowingly collect personal information from children under the age of sixteen (16). If we learn that we have collected information from a child under sixteen, we will take steps to delete it. If you believe a child has provided personal information to us, please write to privacy@delphirive.com.

Do Not Track

Some web browsers offer a "Do Not Track" signal that tells websites the user does not wish to be tracked. As there is currently no agreed industry standard for honoring these signals, we do not respond to them. We do, however, honor the Global Privacy Control (GPC) signal where required by law, and we provide the opt-out mechanisms described above.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the law, or the services we offer. When we do, we will revise the "Effective Date" at the bottom of this page and post the updated policy on the Site. Material changes will be communicated to you through prominent notice on the Site or, where required, by email.

Your continued use of the Site after we post changes constitutes your acceptance of the updated Privacy Policy.

Your CCPA Rights

If you are a resident of California, you have the following rights with respect to your personal information under the California Consumer Privacy Act (as amended by the California Privacy Rights Act):

Right to Know

You have the right to know what personal information we have collected about you, including the categories of information, the categories of sources, the business purposes for collection, and the categories of third parties with whom we share or sell information.

Right to Delete

You have the right to request that we delete personal information we have collected about you, subject to certain exceptions (for example, where the information is necessary to complete a transaction or comply with a legal obligation).

Right to Correct

You have the right to request that we correct inaccurate personal information we hold about you.

Right to Opt Out of Sale or Sharing

We share personal information (including online identifiers, browsing activity, and inferences) with advertising partners such as Meta, TikTok, and Google to deliver cross-context behavioral advertising. Under California law, this may constitute a "sale" or "sharing" of personal information. You have the right to opt out by visiting our Do Not Sell or Share My Personal Information page or by writing to privacy@delphirive.com.

Right to Limit Use of Sensitive Personal Information

We do not use sensitive personal information for purposes other than those permitted under the CCPA. To the extent we do in the future, you will have the right to limit such use.

Right to Non-Discrimination

We will not discriminate against you for exercising your rights under the CCPA. We will not deny you services, charge different prices, or provide a different level of service based on your exercise of these rights.

Categories of Information We Collect & Share

In the past twelve months, we have collected the following categories of personal information:

Identifiers (name, email, postal address, phone, IP address, account credentials)
Customer records (billing and shipping address, payment information)
Commercial information (purchase history, products viewed)
Internet activity (browsing on the Site, interactions with our emails and ads)

We have shared the following categories with advertising partners (Meta, TikTok, Google) for cross-context behavioral advertising:

We have not knowingly sold or shared the personal information of any consumer under the age of sixteen (16).

How to Exercise Your CCPA Rights

To exercise your rights under the CCPA, please write to us at privacy@delphirive.com with the subject line "CCPA Request" and tell us which right you wish to exercise. We may need to verify your identity before fulfilling your request — we will ask for information sufficient to confirm that you are the person about whom we hold information.

You may also designate an authorized agent to make a request on your behalf. We will require written proof of the agent's authority and may also require that you verify your own identity directly with us.

We will respond to verified requests within forty-five (45) days. If we need additional time (up to a further forty-five days), we will notify you of the reason and the extension.

You may submit a request to know or delete up to two times within a 12-month period.

Shine the Light Request

California Civil Code Section 1798.83 permits California residents who have an established business relationship with us to request information about our disclosures of certain categories of personal information to third parties for those parties' direct marketing purposes. To make such a request, please write to privacy@delphirive.com with the subject line "Shine the Light Request."

Your Nevada Rights

Nevada residents have the right to opt out of the sale of certain personal information for monetary consideration. Delphi Rive does not currently sell personal information for monetary consideration as defined under Nevada law.

If you are a Nevada resident and would like to record your preference that we not sell your personal information in the future, please write to us at privacy@delphirive.com with the subject line "Nevada Privacy Request." We will take reasonable steps to verify your identity and the authenticity of your request.

Legal Basis for Processing

Under the GDPR (Article 6) and equivalent provisions of UK and Swiss law, we process your personal data on one or more of the following legal bases:

Performance of a Contract

We process your personal data to fulfill orders, deliver pieces, manage returns and exchanges, and provide customer service in connection with your purchase.

Legitimate Interests

We process your personal data to operate and improve the Site, prevent fraud, conduct internal analytics, and respond to your inquiries. We balance these interests against your rights as a data subject and will not process where your interests override our legitimate ones.

Consent

We process your personal data on the basis of your consent for marketing communications (email and SMS), non-essential cookies, and other purposes specifically disclosed at the time consent is sought. You may withdraw your consent at any time without affecting the lawfulness of processing carried out before withdrawal.

Legal Obligation

We process your personal data where necessary to comply with legal obligations, including tax, accounting, and regulatory requirements.

Your GDPR Rights

If you are a resident of the EU, the UK, or Switzerland, you have the following rights with respect to your personal data:

Right of access — to obtain confirmation of whether we process your personal data, and to access that data
Right of rectification — to have inaccurate or incomplete personal data corrected
Right to erasure ("right to be forgotten") — to have your personal data deleted, subject to certain exceptions
Right to restriction of processing — to restrict our processing of your personal data in certain circumstances
Right to data portability — to receive your personal data in a structured, commonly used, machine-readable format, and to transmit that data to another controller
Right to object — to object to our processing where we rely on legitimate interests, including for direct marketing

To exercise any of these rights, please write to us at privacy@delphirive.com. We will respond within thirty (30) days. We may need to verify your identity before fulfilling your request.

International Transfers from the EU, UK & Switzerland

Delphi Rive is based in the United States. When you provide personal data to us, that data is transferred to and processed in the United States, which the European Commission has not deemed to provide an adequate level of data protection.

Where we transfer personal data of EU, UK, or Swiss residents to the United States or other countries outside the EEA, we rely on appropriate safeguards under Chapter V of the GDPR, including:

Standard Contractual Clauses (SCCs) approved by the European Commission, where we engage processors in non-adequate countries
The UK's International Data Transfer Agreement (IDTA), where applicable
Data processing agreements with our service providers (including Klaviyo, Google, Meta, TikTok, and Wix) that include the SCCs and equivalent UK and Swiss frameworks

Lodging a Complaint

If you believe we have not handled your personal data in accordance with the GDPR or equivalent law, you have the right to lodge a complaint with a supervisory authority:
